Naming Your NGO or Society in Haryana? 3 Costly Mistakes to Avoid

Naming Your NGO or RWA in Haryana? 3 Costly Mistakes to Avoid (HRRS Act 2012)

Before you finalize the letterhead for your new Resident Welfare Association (RWA), NGO, or charitable group, we need to have a practical legal conversation. Over my years of practice handling Society registration in Haryana, I have seen countless founders face immediate rejection of their applications at the Mini Secretariat.

The most common culprit behind these stalled registrations? Choosing an “undesirable name.”

Choosing your society’s name is your first definitive legal act as an organization. Before drafting your Memorandum of Association or Bye-laws, you must understand the strict rules governing names. Here is a plain-English breakdown of what makes a name undesirable and how to navigate the legal requirements to ensure a smooth registration process.

Understanding Your Entity: Society, Trust, or Cooperative?

Before diving into naming rules, you must be entirely clear on your entity type. The legal requirements differ wildly depending on how you structure your organization:

  • Society: Governed under the Haryana Registration and Regulation of Societies Act, 2012 (HRRS Act).

  • Cooperative: Governed under the 1984 Act.

  • Trust: Governed under the 1882 Act.

For this guide, we are looking strictly at registering a Society under the HRRS Act 2012.

Section 7 of the HRRS Act: The 3 Naming Prohibitions

Under Section 7 of the HRRS Act, the District Registrar will rigorously scrutinize your proposed name against three specific prohibitions. If you violate any of these, your application will be instantly dismissed.

1. The Emblems and Names Prohibition

Section 7(1) clearly states that your society’s name cannot violate the Emblems and Names (Prevention of the Improper Use) Act, 1950. This central law prevents private bodies from using names or symbols that trick the public into assuming the organization has official government backing.

  • The Law: You cannot use the names of national heroes, prime ministers, presidents, or restricted state symbols.

  • Practical Example: If you try to register the “Mahatma Gandhi Gurugram Environmental Board,” the District Registrar will reject it. “Mahatma Gandhi” is restricted, and the word “Board” implies a statutory government entity.

  • The Fix: Opt for a descriptive, independent name like “Gurugram Citizens Environmental Welfare Society.”

2. The “Restricted Words” Trap

Section 7(2) outlines a strict list of terminology that is entirely off-limits unless you obtain prior written approval from the Government.

  • The Law: You cannot register a society using words like “Co-operative,” “Land Development,” or “Reserve Bank”. To prevent private groups from assuming false government patronage, you are also barred from using terms like “Union,” “State,” “National,” “International,” or “Universal”. Furthermore, words suggesting a link to local authorities—such as “Municipal” or “Chartered”—are strictly forbidden.

  • Practical Example: A group of teachers wants to form the “National Literacy Society of Haryana.” This is flagged instantly because “National” implies Central Government backing. Similarly, an RWA cannot call itself the “Municipal Welfare Association of Sector 50.”

  • The Fix: Use localized, generic terms. Instead of “National,” try “Haryana Literacy Promoters Society.”

3. The Deceptive Similarity Rule

Section 7(3) acts similarly to trademark protection.

  • The Law: Your society cannot be registered with a name that is identical to, or too nearly resembles, the name of any previously registered Society or corporate body.

  • Practical Example: If a highly successful “Gurugram Animal Rescue Society” already exists on the Haryana Industries & Commerce portal, you cannot register “The Animal Rescue Society Gurugram” or “Gurugram Animal Rescuers.”

  • The Exception: You can use an identical name only if the older society is officially in the process of being dissolved and provides formal, written consent.
